COVID 19 CORONAVIRUS PROTOCOLS, POLICIES AND COVID-19 AND RELEASE OF LIABILITY 


The World Health Organization has declared the novel Coronavirus (COVID-19) is a worldwide pandemic. Due to its capacity to transmit from person-to-person through respiratory droplets and can also be airborne, the government has set recommendations, guidelines, and some prohibitions which: Safe Haven Child Visits Monitoring Services adheres to and will comply (all Professional Providers of Supervised Monitored Visitation, and its Substitute Professional Providers of Supervised Monitored Visitation.

All parties involved in the visit or visit exchange have been informed that as long as this pandemic exists, all Independent Contractor Freelance staff or clients of Safe Haven Child Visits (and any persons present in the room or vicinity of our staff for a visit (with the exception of anyone under the age of 2) must abide by the following:

All parties are required and must wear a mask over their nose and mouth for the entire duration any and all visit and exchange services being conducted; (unless age two or under) if the Center for Disease Control or the county where the services/visits are being held; dictates, stipulates, and/or recommends it.

All parties are required and must wash their hands for a minimum of twenty seconds with warm water and soap, before each visit (please do this before departing for the visit. If the visit is in the someone’s home, all parties present must will wash their hands before the visit in their home. In addition, all aforementioned parties’ must also do so and follow all World Health Organization, County Offices and Officials of the Public Health Department, and the Center for Disease Control (CDC) rules, regulations, and protocols; for exercising safety and sanitary practices for services (for Covid 19 Corona Virus).

Everyone receiving services from our Professional Provider Staff at your visit site or location, exchange site or location will be required, to wear a mask during their aforementioned exchanges or visits (unless two years of age and under) if the CDC, World Health Organization, the Department of Public Health or, the county where the visits are taking place requires it. They must do this anytime they are around our staff of Safe Haven Child Visits Monitoring Services or, it’s Substitute Court Monitors (unless two years of age or younger).

If the visit is in the home of anyone, we also must have you confirm that that no one at your location and has a fever, elevated temperature, and has not been instructed to quarantine; within the last 7 days of the visit, been exposed to anyone with Covid-19 Symptoms, or has tested positive for Covid 19 Corona Virus. You will also have to confirm none of the aforementioned persons are having any Covid 19 Corona Virus symptoms. These include, but are not limited to:

•Fever or chills

•Cough

•Shortness of breath or difficulty breathing

•Fatigue

•Muscle or body aches

•Headache

•New loss of taste or smell

•Sore throat

•Congestion or runny nose

•Nausea or vomiting

•Diarrhea

Look for emergency warning signs for COVID-19. If someone is showing any of these signs, seek emergency medical care immediately:

•Trouble breathing

•Persistent pain or pressure in the chest

•New confusion

•Inability to wake or stay awake

•Bluish lips or face

Call your medical provider for any other symptoms that are severe or concerning to you.

We will also need to know if anyone is experiencing Covid 19 symptoms or been required to quarantine in the last 7 days of the booking date, and the date of your visit. If anyone is exposed to Covid 19 Corona Virus or experiencing symptoms of it, (or anyone you reside with or, came in contact with; you are required to alert the Professional Provider immediately and visits will be postponed; until you or the parties on the visit (who tested positive or were exposed to the Covid 19 Corona Virus) test negative and; present the Court Monitor with a negative test result via email.

You will be required to sign a Covid 19 Corona Virus Waiver and you will receive copies of both. Social distancing will have to be practiced within the reasonable realm, according to the Center for Disease Control and the Public Health Department (six feet apart).

All aforementioned parties must not participate in any services nor, conduct them, if they are experiencing any Covid-19 symptoms, including but not limited to:

Symptoms may appear 2-5 days after exposure to the virus. People with these symptoms may have COVID-19:

•Fever or chills

•Cough

•Shortness of breath or difficulty breathing

•Fatigue

•Muscle or body aches

•Headache

•New loss of taste or smell

•Sore throat

•Congestion or runny nose

•Nausea or vomiting

•Diarrhea

Look for emergency warning signs for COVID-19. If someone is showing any of these signs, seek emergency medical care immediately; and you and all parties that have come into contact with you or reside with you must immediately quarantine for 14 days. If you experience:

•Trouble breathing

•Persistent pain or pressure in the chest

•New confusion

•Inability to wake or stay awake

•Bluish lips or face

Call your medical provider for any other symptoms that are severe or concerning to you. It is suggested you check your temperature with a non-contact infrared thermometer, prior to the event/event services. You stipulate and agree to the following:

In consideration of my participation in the foregoing, the undersigned acknowledges and agrees to the following:

•I am aware of the existence of the risk on my physical appearance to the venue and my participation to the activity of the Safe Haven Child Visits that may cause injury or illness such as, but not limited to Influenza, MRSA, or Covid-19; that may lead to paralysis or death.

•I certify and declare I have not experienced or exhibited symptoms of Covid-19 (which include fever, fatigue, difficulty breathing, dry cough, or exhibiting any other symptoms related to Covid-19, or any communicable disease within the last 14 days.

•I have not, nor any member(s) of my household or anyone who I allow to enter my household, traveled by sea or by air, internationally within the past 30 days.

•I have not been, nor any member of my household, visited any area within the United States, and any areas that was reported to be highly affected by Covid-19; in the last 30 days.

•I have not been, nor any member(s) of my household, diagnosed to be infected with the Covid-19 virus within the last 30 days.

•As a client, organizer of the services being conducted and representing all parties receiving services that I orchestrated or enlisted, or in the vicinity of the services do so hereby decree, I release the aforementioned from any and all (liabilities, claims, demands, actions, legalities, and causes of action whatsoever), directly or indirectly arising out of or related to any loss, damage, injury, or death; that may be sustained by me related to Covid-19 while participating in any activity/visit/exchange; while in, on, or around the premises or while using the facilities that may lead to unintentional exposure or harm; due to Covid-19.

Following the pronouncements above I hereby declare the following:

I am fully and personally responsible for my own safety and actions while and during my participation of the services (visits and exchanges) of and for, Safe Haven Child Visits. I recognize that I may be in any case; be at risk of contracting Covid-19.

With full knowledge of the risks involved, I hereby release, waive, and discharge Safe Haven Child Visits , its board, officers, owners, independent contractors, affiliates, employees, representatives, successors, and assigns from any and all liabilities, claims, demands, actions, legalities, and causes of action whatsoever, directly or indirectly arising out of or related to any loss, damage, injury, or death; that may be sustained by me related to Covid-19 while participating in any activity while in, on, or around the premises or while using the facilities that may lead to unintentional exposure or harm; due to Covid-19.

I agree to indemnify, defend, and hold harmless Safe Haven Child Visits and its board, officers, owners, independent contractors, affiliates, employees, representatives, successors, and assigns; from and against any and all costs, expenses, damages, lawsuits, and or liabilities or claims arising from and against any and all costs, expenses, damages, lawsuits, and/or liabilities or claims arising whether directly, or indirectly from or related to any and all claims made by or against, any of the released party due to injury, loss, or death from or related to Covid-19.

By signing below, I acknowledge that I have read the foregoing Liability Release Waiver and understand its contents; that I am at least eighteen (18) years old and fully competent to give my consent. That I have been sufficiently informed of the risks involved and give my voluntary consent in signing it as my own free act and deed; that I give my voluntary consent in signing this Liability Release Waiver as my own free act and deed with full intention to be bound by the same, and free from any inducement or representation.

This waiver will remain effective until laws and mandates relevant to COVID-19 are lifted by the Federal Government, State Government, Center for Disease Control, World Health Organization, and the Public Health Department for the City, County, and/or State of California.
